A Lawsuit Against Eliquis

Are you or someone you know being attacked with lawsuits against Eliquis and similar generic drugs? Eliquis is just one of many new-age anti-leishness drugs, such as Pradaxa and Xarelto, which are now being aggressively sued by thousands of low-income people in the United States. The reason for this type of onslaught is simple: Generic drugs are not priced in the same way as brand name drugs. In some cases, the medicines are simply less desirable to patients, and this leads to higher prices for them. However, the lawsuits against Eliquis and similar generic drugs are also based on similar reasoning: The lower prices are forcing pharmaceutical companies to use artificial methods in their production and distributing.

There are two main types of lawsuits against Eliquis and similar generic drugs.

One involves a breach of express warranty of the drug; the other involves a breach of warranty of the strength of the medication. No manufacturer can enter into an express warranty with a patient, since medications are never 100% pure when manufactured. A generic drug is also subject to manufacturer error, so it may sometimes produce side effects that are significantly worse than a brand name drug would.

Pharmaceutical companies have also sued pharmacies for not carrying enough of a certain type of Eliquis medication.

For instance, generic Prilosec was pulled from stores in 2021 after two people died from taking it. Another such case involved a woman who was killed by taking too high of a dosage of insulin. In both of these situations, courts found that the pharmacy was negligent in carrying Eliquis. These lawsuits are still ongoing, and if more pharmacies are found to be negligent, the number of lawsuits will only grow.

Many people are surprised to learn that the Food and Drug Administration even allows Eliquis to be sold over the counter, since it is not considered a new drug.

The FDA has not approved Eliquis, nor has it proven its effectiveness or safety. There is no need to approve any drugs before they are shown to be effective and safe. This means that the FDA cannot allow Eliquis on the market, since there have been no studies to indicate that it is safe.

The biggest lawsuit against Eliquis involves the manufacturer, GlaxoSmithKline.

GlaxoSmithKline manufactured Eliquis, while working for Jansport. GlaxoSmithKline did not perform quality tests on the product, allowing Eliquis to pass off as being natural when it was not. As a result of this, Eliquis caused an explosion in its lawsuits. Jansport recalled the product in 2021 and paid a $2.75 million fine to the Food and Drug Administration because of the risk of tainted medications.

It is important to note that despite these lawsuits, Eliquis remains available to patients.

GlaxoSmithKline still has not released a generic version of Eliquis. There is also no known cure for herpes, so Eliquis may very well be useful for those who suffer from outbreaks.
